IMA By-Law No. 4
 
 
 
A By-law relating to compliance with the IMA Code of Ethics and Professional Standards (the "Code"), and the duties of a Professional Compliance Panel (the "Panel").

BE IT ENACTED as a By-law of the Institute of Municipal Assessors as follows:

1. DEFINITIONS

    Institute - the term "Institute" and the term "I.M.A.O." mean the Corporation constituted by Letters Patent, dated the 27th day of May, 1957, under the name
    of "Institute of Municipal Assessors of Ontario" as continued by "An Act Respecting the Institute of Municipal Assessors of Ontario", Statutes of Ontario,
    Third session, 33rd Legislature Bill.     As amended by Supplementary Letters Patent dated the 26th day of June, 1995, changing the name of the Institute
    of Municipal Assessors of Ontario to the Institute of Municipal Assessors, (IMA).

    Professional Compliance Panel - the term "Professional Compliance Panel" or the "Panel" means persons appointed by the Board of Directors (Board) of
    the IMA to perform the duties assigned to the Panel in accordance with this By-law.

2. ESTABLISHMENT OF THE PROFESSIONAL COMPLIANCE PANEL
   
    a) The Board shall appoint at least 5 and no more than 8 persons to constitute a Professional Compliance Panel.

    b) At least three of the persons appointed to the Panel shall be Accredited Members of the IMA.

    c) No more than two of the persons appointed to the Panel may be non- members of the IMA.
 
    d) The Chair of the Panel shall be an accredited member in good standing and will be appointed by the Board.

3. DUTIES OF THE PROFESSIONAL COMPLIANCE PANEL

    a) The Panel will ensure that information respecting the Code of Ethics and Professional Standards and the procedures for dealing with complaints 
        are disseminated to members.

    b) The Panel will ensure that IMA course material respecting the Code of Ethics and Professional Standards is relevant and specifies the roles and 
        responsibilities of the Panel.

    c) Upon request from a member, the Panel shall provide advice to guide the member respecting compliance with the Code of Ethics and 
        Professional Standards.

    d) Upon request the Panel shall provide guidance regarding the meaning and interpretation of the Code of Ethics and Professional Standards, and engage
        in outreach and education for the benefit of the public-at-large.

    e) The Panel shall receive, investigate and adjudicate complaints against IMA members respecting members' compliance with the Code of Ethics 
        and Professional Standards.

     f) In the performance of its duties, the Panel shall be guided by terms of reference approved by the Board.

    g) In the performance of its duties, the Panel shall be guided by a Complaints Procedures Protocol approved by the Board of Directors.

4. DECISIONS OF THE PANEL RESPECTING COMPLAINTS

    a) Where the Panel has determined that a member has violated the Code by demonstrating professional misconduct or conduct unbecoming a member of
        the Institute, the Panel may reprimand, fine, suspend or expel the member from the IMA.

    b) A decision of the Panel respecting complaints against members will be final, subject only to appeal to the Ontario Divisional Court by leave of the Court.

    c) The Panel shall report its decisions on complaints to the Board of Directors and compile an Annual Report for each IMA Annual General Meeting.
